EAC Declaration of Conformity: what is it? Complete guide!

The EAC Declaration of Conformity is characterised by two forms of recognition of the conformity of products with technical principles. The first is the certification form also called EAC Certificate of Conformity, while the second is the declaratory form also called EAC Declaration of Conformity.

The form of the declaration of conformity is a certificate that is easier to obtain than the certificate of conformity, although the procedure for accessing both is almost identical. But what does it change?

 

The first distinctive element is the role of the Applicant, also called third party guarantor or “Declaring Body”, which plays a more operational role. In fact, it operates in a different way from the actual certification body which has a fundamental role in guaranteeing access to certification.

Another change to be registered is certainly that from 1 January 2020. Before this date, declarations of conformity could be registered either by the applicant or by the accredited certification body.

Subsequently, there was a crackdown by the Federal Accreditation Service, which effectively eliminated a number of bodies that produced unnecessary documents without complying with the technical regulations, thus leaving the task only to accredited companies that actually follow the EAC conformity certification process.

EAC declaration and EAC certificate: what are they?

An EAC declaration is a valid document to confirm that products comply with the minimum requirements of the technical regulations in the EEU. The EAC declaration is issued by the manufacturer, importer and entered into the uniform Eurasian Union register. If the compliance of the products is confirmed by the technical regulations, they may be transported and sold on the territory of all EEA member states.

The EAC certificate, on the other hand, is a certification that serves to officially confirm that the characteristics of the products sold comply with the technical directives. Therefore, if compliance is confirmed, the products can be transported and sold in all member states of the EEU (Eurasian Economic Union).

Therefore, these two documents that we simply call “certificates” (even though they are basically two different things) are very important for a number of reasons. First of all, their presence implies the communication of a clear message to end-users: the product complies with the safety standards valid in the country where it is sold. In the absence of the declaration and certification, the goods will not be cleared through customs or the importer will not be able to sell them.

These documents are often used in conjunction with the CE mark, which confirms that products are manufactured in accordance with European directives. However, the EAC mark and the CE mark are two different things, but more importantly, having manufactured a product in accordance with European directives does not mean having manufactured a product in accordance with Russian technical regulations.

In any case, EAC certification has been mandatory since March 2015.

How is the EAC obtained? Documents required

 After this brief overview of the EAC, it is important to understand what documents are required to obtain the Declaration of Conformity. Here is a shortlist of everything you need to know:

  • Manufacturer’s data with a list of any foreign branches or subcontractors of production (the name of the foreign manufacturer should not be given, only the foreign country and address)
  • List of trademarks (commercial brands) under which the product is, will be or maybe marketed
  • Copy of the Contract between the Producer and the Applicant
  • Documentation of products to be submitted for conformity (in Russian)
  • Technical Documentation
  • Customs classification (Taric code or HS code)
  • Samples for Analysis
  • Inspection audit (if required)

How much does the EAC declaration cost?

 How much do EAC certificates and EAC declarations cost? This is probably one of the most frequently asked questions in this field. However, it is not easy to give an answer because it is not straightforward. What is useful to do is to understand which cost items can be included in the issuance of this documentation. Let us look at them in this shortlist:

  • EAC certification costs vary according to the characteristics of the products and their risks
  • The technical regulations that are applied
  • The EAC certificate is significantly more expensive than an EAC declaration. This is due to the fact that several accredited certification bodies are involved, which carry out document control, promotion audit, and an inspection visit every year.
  • Is there a certification or a declaration scheme?

 

Other elements influencing the cost of the certificate and declaration also relate to the requirements of the regulation. Indeed, there may be a greater or lesser complexity and quantity of tests or annual controls.

As mentioned above, the cost also goes up with regard to the involvement of accredited testing institutes or the type of delivery: mass production, single delivery, or contractually agreed on batches.

Finally, there may also be other applicable approvals. We are talking about the approval of measuring instruments, FSB notification, state registration, or FAC certification.
